Indecent Image Investigations
Indecent image cases are frequent types of investigations that are conducted by law enforcement agencies who seek to identify the presence of unlawful images.
They also seek to identify any evidence that may potentially support future allegations brought against the owner of the computer or mobile phone that they had deliberately and intentionally created those unlawful images.
The Limitations of Law Enforcement Indecent Image Investigations
Unfortunately, due to the number of cases dealt with by those agencies, they are almost always unable to investigate the evidence beyond those areas and rarely able to determine whether there is evidence to support the Defendant on the occasions where they claim that they were unaware of the existence of the images.
Being wrongly accused of possessing or making indecent images of children can be damaging to the individual and it is difficult to defend without the same evidence being reviewed and considered by an independent forensic expert such as those at Athena Forensics.
We are frequently instructed by Solicitors who’s clients claim that they have been wrongly accused of offences relating to the presence of indecent images of children that have been identified on their computer or mobile phone.
How We Can Assist in Further Investigating Evidence Involving Indecent Image Cases
Our work normally involves the review of the evidence that has been produced by the Police to consider whether that evidence supports to Prosecution or, in cases where the Defendant denies the allegations, whether there is any evidence present that can support that the Defendant has been wrongly accused.
To do this we would normally investigate the origins and provenance of one or many images and then assess the method of creation of them and whether they had been created knowingly or inadvertently.
For example, one scenario that could demonstrate that the individual had been wrongly accused of creating unlawful images would be that the user downloaded adult material and inadvertently and unwittingly downloaded an indecent image of a child amongst those images, which whilst it may not sound plausible, has been shown to have happened within a number of the cases we have been involved in.
Or maybe the user was browsing a website and was forwarded to another that contained a gallery of different images, including those unlawful images identified by the Police.
